These Terms and Conditions (“Terms”) govern all sales of products (“Products”) by BigTree Furniture L.L.C. (“BigTree,” “we,” “us,” or “our”) through our online store. By placing an order, the Buyer (“you,” “your,” or “Customer”) agrees to these Terms.

Order Acceptance

• All orders are subject to acceptance by BigTree at its designated order processing location.
• Acceptance of delivery constitutes your agreement to these Terms.
• These Terms represent the complete and exclusive agreement between Customer and BigTree. No additional or conflicting terms apply unless expressly approved in writing by an authorized officer of BigTree.

Prices & Payment

• All prices are in UAE Dirhams (AED/د.إ) and may change without prior notice.
• Orders must be paid in full at checkout using the available payment methods.
• Orders will not be processed or shipped until payment is received in full, including any applicable taxes, delivery, and handling charges.

Storage & Restocking Fees

• If goods are not received or accepted within 4 days from the date of arrival or notification of availability, a restocking/storage fee of AED 200 per day will apply.

Order Cancellation

• All cancellation requests, whether before or after shipment, are subject to a 20% cancellation fee of the total order value.

• This fee applies regardless of whether the order is in production, preparation, packing, or any other stage.

Force Majeure

• BigTree shall not be liable for delays or non-performance caused by events beyond its reasonable control, including but not limited to natural disasters, government restrictions, supply chain disruptions, labor disputes, courier delays, or other unforeseen events.

Taxes

• All applicable VAT imposed by relevant authorities in the jurisdiction of sale or delivery are payable by the Customer unless otherwise stated in writing.

Title & Risk of Loss

• Risk of loss passes to the Customer upon delivery to the courier.
• Any claim for shortages or damages must be made in writing within 48 hours of delivery, with supporting evidence (delivery note, photos and video).

Shipping & Delivery

• BigTree arranges delivery through trusted courier partners.
• Delivery timelines provided at checkout are estimates only.
• If a shipment is returned due to refusal or failure to accept delivery, the Customer will bear all additional shipping, handling, and storage costs.

Warranty & Product Variations

• Products are warranted to be free from manufacturing defects at the time of delivery.
• Except as specified herein, BigTree warrants that any goods sold hereunder will be free from defects in workmanship and materials for one (1) year.
• Natural variations in color, texture, finish, and material (including fabrics, leathers, wood, and handmade goods) are not defects but part of the inherent nature of the Products.
• Warranty does not cover damage from misuse, accidents, improper cleaning, or normal wear and tear.

 Limitation of Liability

• BigTree shall not be liable for any indirect, incidental, or consequential damages arising out of or in connection with your use of our products and services.
• Our maximum liability shall not exceed the purchase price of the Product in question.

Remedies Upon Default

• If the Customer fails to make payment or breaches these Terms, BigTree reserves the right to cancel the order, retain any deposits paid, and pursue remedies under applicable law.

Product Information & Variations

• All sizes, weights, colors, and descriptions are approximate and provided for guidance only.
• Handmade, natural, or custom Products may show slight variations which do not constitute as defects.

 Waiver

• Failure by BigTree to enforce any term shall not constitute a waiver of any right or future enforcement.

Severability

• If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force.

Governing Law & Jurisdiction

• These Terms are governed by the laws of the United Arab Emirates (or the relevant jurisdiction where the online store operates).
• Any disputes shall be subject to the exclusive jurisdiction of the courts in the territory of sale.
